What are BEPS? If you are a building owner or operator in the District, BEPS applies to you! BEPS is a regulatory requirement, enacted though the Clean Energy DC Omnibus Act of 2018 that drives energy performance improvements in existing buildings. This landmark legislation is the first in the Nation to require a minimum threshold of energy performance for existing buildings based on the local median Energy Star score by property type (or equivalent metric). The first BEPS cycle began January 1, 2021, for all privately-owned buildings that are 50,000 sq. ft. or larger.

What if my building does not meet BEPS Standards? All buildings over 50,000 sq. ft. are required to establish performance baselines by reporting their Energy Star score to the District’s Department of Energy and Environment (DOEE). If your building is required to make improvements to comply with BEPS, your building will enter the first compliance cycle. For the first cycle, building owners are required to choose a compliance pathway by April 2023 or face financial penalties for non-compliance.
